1. Acceptance of Terms

By accessing or using PropPilot's website at proppilot-13.polsia.app or any related services (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Service.

These Terms constitute a legally binding agreement between you and PropPilot. Please read them carefully. By clicking "Get Started," submitting a patient assessment, or otherwise using the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy.

2. Service Description

PropPilot operates an online healthcare marketplace that connects patients with independently licensed healthcare providers (collectively, "Providers") who offer GLP-1 weight loss treatment services, including:

  • Patient intake assessment and clinical eligibility screening
  • Matching with board-certified physicians licensed in your state of residence
  • Facilitation of asynchronous or synchronous virtual consultations
  • Prescription routing to licensed compounding or retail pharmacies, when ordered by a Provider
  • Access to integrated lifestyle and weight management coaching

PropPilot provides the platform and marketplace infrastructure. All medical services โ€” including diagnosis, prescription issuance, and clinical care โ€” are provided by independent, licensed Providers, not by PropPilot. The $199 per month Subscription Fee covers access to the marketplace, provider matching, and care coordination services only.

3. Not a Healthcare Provider

PropPilot is a technology platform and marketplace โ€” not a healthcare provider, medical practice, licensed medical entity, or pharmacy. We do not provide medical advice, diagnosis, or treatment. We do not employ or supervise the physicians on our platform.

All medical decisions โ€” including whether GLP-1 receptor agonist medications are appropriate for you, the dosing and duration of any prescribed therapy, and the monitoring required during treatment โ€” are made solely by the independent, licensed Providers on our platform. PropPilot does not influence, override, or direct clinical decisions.

The content on this website is for informational purposes only and does not constitute medical advice. Always consult a qualified physician before starting, stopping, or changing any treatment program.

In a medical emergency, call 911 or your local emergency services immediately. The Service is not designed for emergency healthcare situations.

4. Telehealth Consent and Limitations

By submitting a patient assessment and proceeding with services through our platform, you consent to receive healthcare services via telemedicine, subject to the following:

What You Are Consenting To

  • Asynchronous (store-and-forward) review of your health assessment by a licensed physician, who will evaluate your clinical information and determine whether a GLP-1 prescription is medically appropriate
  • Electronic transmission of your health information to a licensed Provider and, if a prescription is issued, to a licensed pharmacy
  • Follow-up communications from your Provider or the PropPilot care coordination team via the contact information you provide

Telehealth Limitations

You acknowledge and understand that:

  • Telehealth services have inherent limitations compared to in-person care. A Provider evaluating your assessment remotely does not have the benefit of a physical examination.
  • Your Provider may determine that an in-person evaluation is medically necessary before issuing a prescription, and may decline to prescribe via telemedicine in their clinical judgment.
  • Telehealth is not appropriate for all conditions. If you experience symptoms that require immediate evaluation โ€” including allergic reactions, severe side effects, or a medical emergency โ€” seek in-person care immediately.
  • Technical failures (internet connectivity issues, platform downtime) may interrupt or delay services. PropPilot is not liable for delays caused by technical failures outside our reasonable control.

State Telehealth Laws

The availability of telehealth services and the scope of what Providers may prescribe via telemedicine varies by state. By using the Service, you represent that you are physically located in a state where PropPilot operates and where telehealth prescribing of GLP-1 medications is permitted. You agree to promptly notify us if you relocate to a state where services are unavailable.

5. Eligibility and State Availability

To use the Service, you must:

  • Be at least 18 years of age. The Service is available to adults only. Individuals under 18 may not use the Service under any circumstances.
  • Be a resident of a U.S. state where PropPilot currently operates. Service availability varies by state due to differences in telehealth laws and provider licensure. We will verify your state of residence during the intake process.
  • Provide accurate, complete, and truthful information in your patient assessment and all subsequent communications with Providers. Providing false or misleading health information to influence a prescribing decision is a misuse of the Service and may constitute fraud.
  • Not be prohibited from using the Service under applicable federal or state law.

State availability disclaimer: PropPilot does not operate in all 50 states. Availability is subject to change as state telehealth laws evolve. Completion of the patient assessment does not guarantee that services are available in your state or that you will receive a prescription.

PropPilot reserves the right to refuse or terminate service to anyone at any time, including if we have reason to believe you have provided false information, are misusing the Service, or are located in a state where we do not operate.

6. Account Registration

To access certain features of the Service, you may be required to create an account. You agree to:

  • Provide accurate and complete registration information, including your legal name, date of birth, and state of residence
  • Maintain the security of your account credentials and not share your password with any third party
  • Notify us immediately of any unauthorized use of your account at support@proppilot-13.polsia.app
  • Accept responsibility for all activities that occur under your account

You may not create an account on behalf of another person without their explicit written authorization, and you may not create multiple accounts to circumvent eligibility determinations or service restrictions.

7. Payment Terms

PropPilot's Subscription Fee is $199 per month, which provides access to the marketplace, provider matching, and ongoing care coordination services.

  • The Subscription Fee is billed monthly on the date you first subscribe
  • All fees are billed in U.S. dollars
  • By subscribing, you authorize PropPilot to charge your payment method on file for recurring monthly fees until you cancel
  • The Subscription Fee covers marketplace access and care coordination only โ€” it does not include fees charged directly by Providers for medical services
  • Medication costs (including GLP-1 prescriptions such as semaglutide, tirzepatide, or compounded equivalents) are not included in the Subscription Fee and are billed separately by the dispensing pharmacy
  • Pharmacy medication costs are not controlled by PropPilot and may vary based on your prescription, pharmacy, and insurance status

You will not be charged the Subscription Fee unless a physician determines you are medically appropriate for treatment and you confirm you'd like to proceed.

Payments are processed by our third-party payment processor (Stripe, Inc.). PropPilot does not store your full payment card information. By providing payment information, you authorize us to charge your payment method as described in these Terms and in accordance with our payment processor's terms of service.

8. Cancellation Policy

You may cancel your subscription at any time by contacting us at support@proppilot-13.polsia.app.

  • Cancellations take effect at the end of your current billing period; you retain access through the end of that period
  • We do not provide refunds for partial months or unused portions of a subscription period
  • Any charges for completed medical services are non-refundable once a Provider has completed their review of your assessment
  • Pharmacy charges are subject to the cancellation and return policies of the dispensing pharmacy, not PropPilot

If you believe you have been charged in error, contact us within 30 days of the charge and we will investigate. PropPilot's determination regarding billing disputes is final, subject to applicable consumer protection laws.

9. Prescription Medication Disclaimers

GLP-1 receptor agonist medications carry significant risks and are not appropriate for all patients. Prescriptions are issued solely at the clinical discretion of independent, licensed physicians.

GLP-1 Medication Risks

GLP-1 receptor agonists (including but not limited to semaglutide and tirzepatide) are prescription medications with known risks, including:

  • Gastrointestinal side effects (nausea, vomiting, diarrhea, constipation)
  • Risk of pancreatitis
  • Contraindication in patients with a personal or family history of medullary thyroid carcinoma or Multiple Endocrine Neoplasia syndrome type 2 (MEN 2)
  • Potential drug interactions with other medications you may be taking
  • Renal impairment associated with severe gastrointestinal adverse reactions
  • Other risks described in the FDA-approved prescribing information for each medication

You are responsible for disclosing your complete and accurate medical history, current medications, and relevant family history to your Provider. PropPilot is not liable for adverse outcomes resulting from information you failed to disclose.

Compounded Medications

Some prescriptions fulfilled through our platform may be compounded by a licensed 503A or 503B compounding pharmacy. Compounded medications are not FDA-approved drug products, though they may be legally prescribed by a licensed physician. Compounded versions of GLP-1 medications are not evaluated by the FDA for safety, efficacy, or quality in the same manner as FDA-approved drugs. Your Provider will advise you on whether a compounded or FDA-approved formulation is appropriate for your treatment.

No Guarantee of Prescription

Submitting a patient assessment does not guarantee that you will be approved for GLP-1 treatment or that a prescription will be issued. Prescribing decisions are made exclusively by the licensed Provider in their independent clinical judgment. PropPilot has no authority to influence, override, or reverse a Provider's clinical decision.

PropPilot Liability Limitation for Medications

PropPilot's liability with respect to prescription medications is explicitly limited. PropPilot is not a prescriber, dispenser, or manufacturer of any medication. PropPilot is not responsible for: (a) a Provider's prescribing decision or failure to prescribe; (b) the quality, safety, or efficacy of any medication dispensed by a third-party pharmacy; (c) side effects, adverse reactions, or interactions arising from medications prescribed by independent Providers; or (d) delays in prescription fulfillment by third-party pharmacies.

10. User Conduct

You agree not to:

  • Provide false, incomplete, or misleading information in your assessment or to Providers โ€” including misrepresenting your health history, current medications, or contraindications to GLP-1 therapy
  • Use the Service for any unlawful purpose, including obtaining prescription medications for resale or distribution
  • Attempt to obtain prescriptions for persons other than yourself through this platform
  • Attempt to gain unauthorized access to any part of the Service or another user's account
  • Interfere with or disrupt the Service, its infrastructure, or its security measures
  • Resell or commercially exploit access to the Service
  • Use the Service to harass, abuse, or harm any Provider, employee, or other user
  • Attempt to reverse engineer, decompile, or extract source code from any part of the Service

Violation of these conduct standards โ€” particularly providing false medical information โ€” may result in immediate termination of your account and may be reported to appropriate regulatory or law enforcement authorities.

11. Intellectual Property

The Service and all content, features, and functionality thereof โ€” including text, graphics, logos, images, and software โ€” are owned by PropPilot or its licensors and are protected by applicable intellectual property laws, including U.S. copyright and trademark law.

You are granted a limited, non-exclusive, non-transferable, revocable license to access and use the Service for personal, non-commercial purposes consistent with these Terms. You may not copy, modify, distribute, sell, lease, sublicense, or create derivative works from any part of the Service or its content without our prior written consent.

12. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. PropPilot expressly disclaims all warranties, including but not limited to:

  • Warranties of merchantability, fitness for a particular purpose, and non-infringement
  • Warranties that the Service will be uninterrupted, error-free, or secure
  • Warranties regarding the accuracy, reliability, or completeness of any content on the Service
  • Warranties regarding the qualifications, competency, or quality of care provided by independent Providers
  • Warranties that GLP-1 medications prescribed through the Service are safe, effective, or appropriate for your individual circumstances

PropPilot does not warrant that any particular treatment outcome will result from use of the Service. Individual clinical responses to GLP-1 therapy vary significantly. Medically supervised weight loss typically requires sustained adherence and lifestyle changes in addition to pharmacotherapy.

13. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, PROPPILOT AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND AFFILIATES SHALL NOT BE LIABLE FOR:

  • Any indirect, incidental, special, consequential, or punitive damages
  • Loss of profits, data, goodwill, or business opportunities
  • Damages arising from any medical decision made by an independent Provider, including decisions to prescribe or not prescribe any medication
  • Adverse reactions, side effects, or health outcomes arising from medications prescribed by independent Providers or dispensed by third-party pharmacies
  • Damages arising from the quality, safety, or efficacy of compounded or FDA-approved medications
  • Damages arising from your reliance on information provided on this website as medical advice
  • Damages arising from your use of or inability to use the Service

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO PROPPILOT IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS ($100). THIS LIABILITY CAP DOES NOT APPLY TO CLAIMS THAT CANNOT BE LIMITED UNDER APPLICABLE LAW, INCLUDING CLAIMS ARISING FROM FRAUD OR GROSS NEGLIGENCE.

Some jurisdictions do not allow certain exclusions or limitations of liability. In such jurisdictions, our liability will be limited to the greatest extent permitted by applicable law.

14. Indemnification

You agree to indemnify, defend, and hold harmless PropPilot and its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or in any way connected with:

  • Your access to or use of the Service
  • Your violation of these Terms
  • Your violation of any third-party rights, including any intellectual property, privacy, or medical ethics obligations
  • Any false, misleading, or incomplete information you provide to PropPilot or to a Provider
  • Your misuse of any prescription medication obtained through the Service

15. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of Delaware, without regard to its conflict of law provisions. The federal courts located in the District of Delaware and the state courts located in New Castle County, Delaware shall have exclusive jurisdiction over any disputes not subject to arbitration under this Section.

Informal Resolution

Before filing any formal legal action, you agree to contact us at support@proppilot-13.polsia.app with a written description of the dispute, the relief sought, and your contact information. You agree to attempt to resolve the dispute informally for at least 30 days before initiating arbitration or litigation. We will make reasonable good-faith efforts to resolve disputes through this process.

Binding Arbitration

If informal resolution fails, any unresolved dispute, claim, or controversy arising out of or relating to these Terms or the Service (including questions of arbitrability) will be resolved by final and binding individual arbitration, rather than in court, administered by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules, which are available at www.adr.org.

The arbitration will be conducted on an individual basis. You and PropPilot each waive the right to participate in a class action lawsuit, class-wide arbitration, or any representative proceeding. If a court finds this class waiver unenforceable, then this entire arbitration agreement will be null and void with respect to that dispute.

The arbitrator may award the same relief that a court could award, including injunctive or declaratory relief, but only on an individual basis. Arbitration will be conducted remotely unless both parties agree otherwise. The AAA filing fees will be governed by the AAA Consumer Arbitration Rules.

Arbitration Opt-Out

You may opt out of this arbitration agreement by sending written notice to support@proppilot-13.polsia.app within 30 days of first accepting these Terms. Your notice must include your name, address, and a clear statement that you are opting out of arbitration. If you opt out, all disputes will be resolved in the courts specified above.

Exceptions

Nothing in this Section prevents you from: (a) bringing eligible claims in small claims court; (b) seeking emergency injunctive relief in any court of competent jurisdiction to prevent irreparable harm pending arbitration; or (c) filing a complaint with a government agency or regulatory body.

16. Changes to Terms

We reserve the right to modify these Terms at any time. We will provide advance notice of material changes via email (at least 30 days before the effective date) or by posting a prominent notice on the Service. Your continued use of the Service after the effective date of revised Terms constitutes your acceptance of the changes.

If you do not agree to the revised Terms, you must stop using the Service and cancel your subscription. Changes to these Terms will not apply retroactively to disputes already subject to arbitration or pending litigation.
